When merchandise purchased with one of these Rewards is returned, the reward amount will be returned to your Eddie Bauer Adventure Rewards account and will be available the next redemption period.
Rewards whose code begins with something other than Q are promotional in nature and are not created by converting a member’s points value into a Reward. Therefore, when a return of an item from a purchase with this cert type is made, there is no reward amount to refund and no additional value will be added to a member’s Adventure Rewards account.

GENERAL
By enrolling in our program, you agree to the terms and conditions, that we may change or amend, including any benefits under the program and the conditions and levels for earning Rewards at any time. If the amendment results in an increase of your obligations or a reduction in our obligations and you do not accept the change, you may cancel your participation in the program without cost, penalty, or cancellation indemnity by sending us a notice to that effect no later than 30 days after the amendment comes into effect or by simply not using your rewards number when shopping. We reserve the right to terminate rewards accounts at any time and will occasionally do so when accounts become inactive. Terminated accounts are no longer available for use and will lose any existing points balance, will no longer accrue points with purchases, and will not be eligible for rewards. BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER
Our first objective is to satisfy our customers, and so we hope to never have a dispute with you. But if we can't avoid a dispute, you and we agree to try for 60 days from the date you notify us of your concern to resolve it by agreement. If we cannot resolve the dispute by agreement within 60 days:
FOR U.S. RESIDENTS:
Binding Arbitration Agreement: We will submit adjudication of our dispute to binding individual arbitration before the American Arbitration Association ("AAA") under the Federal Arbitration Act ("FAA"). You and we agree that a neutral arbitrator will adjudicate our dispute and the arbitrator's decision will be final except for a limited right of appeal under the FAA.
The arbitration procedure is as follows:
1. Notice of Dispute/Arbitration. If our customer service representatives have been unable to resolve your dispute, you must notify us of the dispute in writing. You must send your notice by first class United States mail to Eddie Bauer LLC, ATTN: General Counsel "INFORMAL DISPUTE RESOLUTION", 2200 1st Ave S Suite 400, Seattle, WA 98134. We must know your name, contact information, a description of the dispute, and what you want us to do. If we are unable to resolve the dispute after the 60 day period from the date we receive your written dispute notice, you may initiate an arbitration demand with a notice in writing to the same address above.
2. The Arbitration Hearing. If the dispute involves $10,000 or less, the arbitration hearing will be conducted by telephone unless the arbitrator decides it should be in-person. However, you may choose to have an in-person arbitration hearing in your county of residence or principal place of business, or our principal place of business—King County, Washington. The arbitrator may award damages.
3. Filing and Attorneys' Fees. We will promptly reimburse filing fees that you incur to initiate any arbitration proceeding (this does not include the AAA fees or arbitrator's fees). If you initiate the arbitration, we may recover the AAA fees or arbitrator's fees, or filing fees we reimbursed, only if the arbitrator finds the arbitration frivolous or brought for an improper purpose. If we initiate the arbitration, we will bear the AAA's and arbitrator's fees under any circumstance. We will not seek our attorneys' fees or expenses from you in any arbitration.
If a court finds any part of this Binding Arbitration Agreement and Class Action Waiver illegal or unenforceable, the part that the court has found to be illegal or unenforceable will be severed, and the rest of this Binding Arbitration Agreement and Class Action Waiver will remain in full force and effect. If a court finds that you have the right to bring an action in court and have our dispute decided by a judge or jury, you agree that any action at law or in equity arising out of or relating to these Terms of Use shall be filed only in state or federal court located in Seattle, Washington, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these Terms of Use.
You and we agree to give up our rights to sue in court and have our dispute decided by a judge or jury.
However, we agree that if your claim is small enough that the law allows you to file it in a small claims court, you may do so instead of submitting to binding arbitration. We will submit to binding arbitration in any event.
Class Action Waiver: You also agree to waive—that is, to give up—your right to claim through a class action lawsuit, class-wide arbitration, private attorney-general action, or any other proceeding where someone acts in a representative capacity or individual claims are combined. You accept this Binding Arbitration Agreement and Class Action Waiver by your purchase and or use of the products, or services that we sell you (including by becoming an Eddie Bauer Adventure Rewards member). You agree to abide by these terms without modification. We reserve the right to change terms from time to time.
To the extent this Agreement conflicts with the AAA's Commercial Arbitration Rules and Supplementary Procedures for Consumer-Related Disputes, this Agreement will control.
The program will be governed by the laws of the State of Washington, without giving effect to its conflict of laws provisions.
FOR CANADIAN RESIDENTS:
Binding Arbitration Agreement: The dispute will be determined by arbitration as set out below. If any part of these terms is found to be void or unenforceable under applicable law, all other parts of the terms will still apply.
To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim (a "Notice of Dispute") to Eddie Bauer LLC, ATTN: General Counsel "INFORMAL DISPUTE RESOLUTION", 2200 1st Ave S Suite 400, Seattle, WA 98134. After we receive the Notice of Dispute, you and we will have sixty (60) days to attempt to resolve your concerns. If our efforts are unsuccessful, you will be entitled to deliver a Notice of Arbitration to the same address set out above. If the amount in issue is less than $10,000, the hearing will be conducted by telephone unless the arbitrator decides it should be conducted in person. The arbitration will be conducted in accordance with the ADR Chambers Arbitration Rules. The law of the arbitration will be Ontario law.
This dispute resolution clause applicable to Canadian residents will be interpreted and construed under the laws of the Province of Ontario, without regard to conflict of laws rules. The Arbitration Act, 1991, S.O. 1991, c. 17, as amended, applies to a dispute related to the Adventure Rewards program. Class Action Waiver: You also agree to waive—that is, to give up—your right to claim through a class action lawsuit, class-wide arbitration, or any other proceeding where someone acts in a representative capacity or individual claims are combined (the "Class Action Waiver"). However, we agree that if your claim is small enough that the law allows you to file it in a small claims court, you may do so instead of submitting to binding arbitration. If for any reason a claim proceeds in court rather than in arbitration, we agree to waive any right to a jury trial, and you and we attorn to the exclusive jurisdiction of the courts of the Province of Ontario.
These arbitration terms will survive the termination of the Adventure Rewards terms or your relationship with us. If any or any part of these arbitration terms are found to be void or unenforceable under applicable law, all other parts of this arbitration provision and of the Adventure Rewards terms will still apply, except that if the Class Action Waiver is found to be void or unenforceable in any way, all of the arbitration terms shall be deemed void and shall not apply, but all other parts of the Adventure Reward terms will still apply.
EDDIE BAUER CREDIT CARD BANK LIMITED LIABILITY (both U.S. and Canadian residents) Limited Liability.

In addition, Comenity, its affiliates, officers, directors, employees, or agents will not be liable to you, or anyone making a claim on your behalf, in connection with any claim relating to any products or services purchased using any Reward obtained through the Program.
